Mesa Riders and Arizona’s Lane-Use, Liability and Damages Rules
Where a motorcycle was in the lane, and who else contributed to the crash, can be the contested facts in a Mesa motorcycle claim. Arizona’s lane-use statute and its several liability rule speak to both, and its constitution addresses the size of the award.
A Motorcycle’s Right to the Lane
A.R.S. § 28-903(A) entitles every motorcycle to the full use of a lane and bars any driver from depriving a motorcycle of that use, except for motorcycles riding two abreast. Subsections (B) and (C) bar a motorcycle from passing in the same lane as the vehicle overtaken and from riding between lanes or rows of vehicles, except under subsection (F): a two-wheeled motorcycle may pass a stopped vehicle in its lane and move between lanes only if it is safe, the street has at least two lanes in the same direction with a speed limit of 45 miles per hour or less, and the motorcycle goes no faster than 15 miles per hour.
More Than One At-Fault Party
A.R.S. § 12-2506(A) limits each defendant to the share of damages matching its percentage of fault. Under subsection (B), the jury also considers the fault of nonparties, such as a driver the rider settled with or a person a defendant named in a pretrial notice, but only to measure the named parties’ fault. Under § 12-2505(A), the rider’s own fault reduces the award without barring it; for example, imagine $100,000 in damages with the rider 35 percent at fault, leaving $65,000.
No Statutory Limit on Recovery
Article 18, Section 6 of the Arizona Constitution provides that the right of action to recover damages for injuries shall never be abrogated and that the amount recovered shall not be subject to any statutory limitation, apart from an exception for claims against crime victims by people harmed during felony conduct.
Mesa Motorcycle Accident Questions
Who has to wear a helmet or eye protection in Arizona?
A.R.S. § 28-964(A) requires operators and passengers under 18 to wear a secured protective helmet, and requires every operator to wear approved glasses, goggles or a transparent face shield unless the motorcycle has a protective windshield.
What are the deadlines to file?
A.R.S. § 12-542 requires a personal injury action within two years after accrual, except as provided in § 12-551. A claim against a public entity or public employee must be filed within 180 days under § 12-821.01 and the lawsuit brought within one year under § 12-821.
What must the driver do after hitting a rider?
A.R.S. § 28-661 requires the driver of a vehicle in a crash causing injury or death to stop immediately at or as close as possible to the scene and remain there until the duties in § 28-663 are fulfilled, including rendering reasonable assistance to anyone injured.
