State and City Vehicle Claims, Drunk Driving and Hit-and-Run Rules for Austin Car Crashes

An Austin car crash with a state or city vehicle runs against a governmental unit under its own liability rules and caps. When the other driver was intoxicated or left the scene, Texas criminal statutes and the exemplary damages rules apply alongside the civil claim.

Claims Against the State or the City

Under Texas Civil Practice and Remedies Code 101.021, a governmental unit is liable for injury caused by an employee’s operation or use of a motor-driven vehicle within the scope of employment when the employee would be personally liable. Under 101.023, liability for bodily injury or death is limited to $250,000 per person and $500,000 per occurrence for the state and for a municipality such as the City of Austin, with $100,000 per occurrence for property damage. Under 101.055(2), the chapter does not reach an employee’s emergency response that followed the laws for emergency action or, where none applies, was not taken with conscious indifference or reckless disregard for others’ safety.

The Notice Deadline

Under Section 101.101(a), a governmental unit is entitled to notice of the claim within six months after the incident, describing the injury, the time and place, and the incident. A city’s charter and ordinance notice periods permitted by law are ratified under 101.101(b), and the requirement does not apply under (c) when the unit has actual notice of the death, injury or damage.

A Drunk Driver

Under Texas Penal Code 49.04, operating a motor vehicle in a public place while intoxicated is a Class B misdemeanor with a minimum of 72 hours of confinement, six days with an open container, and a Class A misdemeanor with an alcohol concentration of 0.15 or more. In the civil claim, the exemplary damages cap in Civil Practice and Remedies Code 41.008(b) does not apply under 41.008(c) to conduct described as intoxication assault or intoxication manslaughter.

A Driver Who Leaves

Under Texas Transportation Code 550.021, a driver in a collision that results or is reasonably likely to result in injury or death must stop, determine whether anyone needs aid and remain at the scene. Failing to do so is a second-degree felony when the collision causes death and a third-degree felony when it causes serious bodily injury.

Austin Car Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Civil Practice and Remedies Code 33.001. For example, imagine $100,000 in damages and 30 percent of the responsibility on the injured driver: the recovery would be $70,000.

How long do I have to sue?

Two years after the day the cause of action accrues under Section 16.003(a), and two years after the death under 16.003(b) for wrongful death; under 16.001, time while a claimant is younger than 18 is not counted if the disability existed when the claim accrued.

Does my policy include personal injury protection?

Yes, unless it was rejected in writing. Under Texas Insurance Code 1952.152, an automobile liability policy must include personal injury protection unless any insured named in the policy rejects it in writing.
