Coverage, Helmet and Fault Rules for Glendale Motorcycle Claims in Arizona

A Glendale rider hit by an uninsured driver or a driver who had been drinking can look beyond that driver under Arizona law. The rules below cover those sources of recovery, the helmet requirement and how a rider’s own fault is counted.

The Rider’s Own Uninsured Motorist Coverage

A.R.S. § 20-259.01(A) requires every insurer writing motor vehicle liability policies to offer uninsured motorist coverage by written notice, on a form approved by the director, in limits not less than the policy’s bodily injury limits. The policy declarations page is the final expression of the named insured’s decision to purchase or reject it, so that page shows whether the coverage is part of the rider’s policy.

A Bar That Served the Driver

Under A.R.S. § 4-311(A), a liquor licensee is liable for injuries or wrongful death when it sold spirituous liquor to an obviously intoxicated purchaser, or to an underage purchaser without checking identification or with knowledge of the age, the purchaser consumed it, and that consumption was a proximate cause of the harm.

Helmets and Eye Protection

A.R.S. § 28-964(A) requires operators and passengers under 18 to wear a secured protective helmet, and every operator to wear approved glasses, goggles or a transparent face shield unless the motorcycle has a protective windshield.

Fault Reduces the Award

Under A.R.S. § 12-2505(A), the rider’s fault reduces the full damages proportionately and does not bar recovery. For example, imagine $100,000 in damages and 60 percent of the fault on the rider: the recovery would be $40,000.

Glendale Motorcycle Accident Questions

Does the helmet rule cover a three-wheeled motorcycle with an enclosed cab?

No. A.R.S. § 28-964(A)(1) excludes electrically powered three-wheeled vehicles and three-wheeled vehicles on which the operator and passenger ride within an enclosed cab.

How long do I have to file a claim?

A.R.S. § 12-542 requires a personal injury action within two years after accrual, except as provided in § 12-551. A claim against a public entity or public employee is due within 180 days under § 12-821.01, with suit within one year under § 12-821.

Who may sue if a rider was killed?

Under A.R.S. § 12-612, the surviving spouse, a child, a parent or guardian, or the personal representative may bring the action for the surviving spouse, children or parents, or for the estate if none survive.
