Headgear and Passenger Rules, Crash Notice and Shared Responsibility for Dallas Motorcycle Crashes
A Dallas motorcycle crash claim can raise whether the rider and any passenger were covered by the Texas headgear statute, who had to be notified after the crash, and how responsibility is divided among everyone involved. A separate rule protects claims of injured riders younger than 18.
Headgear for Riders and Passengers
Under Texas Transportation Code 661.003(a), it is an offense to operate or ride as a passenger on a motorcycle on a public street or highway without protective headgear meeting the department’s safety standards, and under (b) it is an offense to carry a passenger who is not wearing it. Under (c), the rule does not apply to a person at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries. Under (h), the fine is $10 to $50.
Notice to the Police
Under Section 550.026(a), a collision causing injury, death or damage that leaves a vehicle unable to be normally and safely driven must be reported immediately by the quickest means of communication to the local police department when it occurs in a municipality such as Dallas.
Shared Responsibility
Under Texas Civil Practice and Remedies Code 33.003(a), the trier of fact assigns a whole-number percentage of responsibility to each claimant, defendant, settling person and responsible third party designated under 33.004. Under 33.012(a), the rider’s damages are reduced by the rider’s own percentage.
Riders Younger Than 18
Under Section 16.001, a person younger than 18 is under a legal disability; if the disability exists when the cause of action accrues, its time is not included in the limitations period, and a disability that arises later does not suspend the period.
Dallas Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $90,000 in damages and 40 percent of the responsibility on the rider: the recovery would be $54,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death. When a City of Dallas vehicle or road condition is involved, Section 101.101 entitles the city to notice within six months after the incident unless it had actual notice of the injury, and a charter notice period ratified under 101.101(b) can apply instead; check that period before relying on six months.
Who brings the claim if a rider is killed?
The surviving spouse, children and parents, or any of them for the benefit of all, under Section 71.004; if none has begun the action within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.
